Very disappointing organisation when it comes to conducting investigations into Council behaviour. I have been informed previously that the NSW Ombudsman’s office is a `toothless tiger` and the plethora of on-line reviews by members
of the public further reinforce this sentiment. I now agree with those reviews.
s26 of the Ombudsman’s Act clearly states, “Where, in an investigation under this Act, the Ombudsman finds that the conduct of the subject of the investigation, or any part of the conduct, is of any one or more of the following kinds-- (a) contrary to law, (b) unreasonable, unjust, oppressive or improperly discriminatory they should investigate. I clearly articulated how a regional council in NSW had breached s52 of the Australian Consumer Law yet the Ombo's office decide to decline any further involvement contrary to their own legislative requirements.
If the Ombo’s office think that this type of behaviour is `above board` then heaven help consumers when it comes to obvious wrong-doing or `unreasonable` action by government departments. They are too busy telling everyone to address your concerns with ICAC or the Office of the Local Government ('OLG') and abrogate their own responsibilities. Their website is too busy telling you what they won't investigate rather than what they should be investigating.
A waste of taxpayers money, but what's new!
I also note the `generic` response to these reviews from the Ombo's office, although when you contact them, nothing changes. Useless!!
