If you are a defendant or litigant with a case pending before this court, you’ll appreciate the most recent batch of retirements and new appointments. For the last twenty or so years, many judges from this court engaged in quiet non-decent. What this is….these moral-less judges would strike a pact, “if you don’t decent my opinion, I won’t decent yours”. As harmless as such practice may seem, in actuality, it’s very bad. As used historically in this court, it becomes a “if you don’t decent my bad opinion, I’ll not decent your bad opinion”. Judges guilty of this behavior, though now retired are Fybel, Ikola, Aronson, just to name a few. Interestingly, any panel having O’Leary as a participant would be devoid of this bad behavior, because she was and is always willing to write a decenting opinion. Sadly, one member of non-decenters remains today, they being the dishonorable Eileen Moore. You’ll recognize her as being the jurist boasting a questionable degree, from a diploma mill university she never attended, obtained after more than twenty years on the bench, “achieved” solely to get a raise in pay from the state. Sadly, she will likely remain on the bench till her death. Her belief that she is superior in skill to her peers makes her reluctant to seek part-time retirement work from ADR. Simply put, she’s too good to work amongst her peers. Also, her reverse mortgage won’t support her lifestyle, and her many failed marriages mean she will always remain a single income existence. All we can do is wait for nature to take its course. Till then, hope and pray she’s not on your panel.
